These terms and conditions are in addition to:

 

  • the standard terms and conditions that form part of your agreement for Virgin Media Business Limited (“Virgin Media”) services.
  • the standard terms and conditions of your agreement for your eligible Telefonica UK Limited (“O2”) services.

Please read through these terms carefully.

 
 

The following terms and conditions govern the ‘Tech Donation Programme’ promotion and only form a part of your Virgin Media Business Limited and Telefonica UK Limited (together, “Virgin Media O2”) customer contract where the Eligibility Criteria are met, and a Qualifying Order is made.

 
 
 
 

Please note:

 

  • Separate contracts apply to your Virgin Media Business services and the O2 mobile services and you will be billed separately for these services
  • Your contract for Virgin Media Business services is with Virgin Media; and
  • Your contract for your eligible O2 mobile tariff is with O2.

For customers who have had their Tech Donation Programme benefit request accepted, Virgin Media O2 reserves the right to change or withdraw the Tech Donation Programme Terms and Conditions in accordance with the Virgin Media and O2 Standard Terms and Conditions. Otherwise, this offering may be withdrawn at any time.

 
 

A. Eligibility Criteria for the Tech Donation Programme

  1. In order to benefit from the Tech Donation Programme you must satisfy the eligibility criteria set out in this Section A (the “Eligibility Criteria”).
  2. Customer Status: to benefit from the Tech Donation Programme you must be an existing Virgin Media O2 customer, who has a valid and lawful agreement with either Virgin Media or O2 of either one of more of the Eligible Services, commencing after 25 September 2023 (the “Effective Date”).
  3. Eligible Products and Services: for the purposes of the Tech Donation Programme:
        a) “Eligible Service” means those of its business mobile, data or voice services, packages or bundles that Virgin Media O2 may (in its sole discretion) determine to be eligible for the Tech Donation Programme. As of the Effective Date, the Eligible Business Services include:
    The Virgin Media services, marketed as:
            i. SD-WAN; or
    The O2 services, marketed as:
            i. Mobile Tariffs, including data plans or voice tariffs either separately or in combination.
    which, in Virgin Media O2’s sole discretion, achieve a minimum annualised total contract value of £200,000.

    Virgin Media O2 may (at its sole discretion) update, change or withdraw certain services, packages or bundles from the Eligible Services without prior notice to customers. Any update or change to the Eligible Services shall not affect any customer or service that has already made a valid claim as at the date of such change
  4. Effective Date: An Eligible Service will only be considered to meet the Eligibility Criteria for the purposes of the Tech Donation Programme when purchased by a customer after the Effective Date. Services purchased before this date will not count towards the Eligibility Criteria. 
  5. Opt-In: The Tech Donation Programme is an opt-in benefit that Virgin Media O2 will provide through its partner, Hubbub (Registered Company No. 09038107). In order to apply to receive the Tech Donation Programme benefit, customers meeting the Eligibility Criteria must contact Customer Services or their dedicated account manager when purchasing the Eligible Service and request that the Eligible Service receive the benefit. At the point of opt-in, customers meeting the Eligibility Criteria will elect their community group demographical and geographical preference. Following that request, Virgin Media O2 shall use its reasonable endeavours to apply the Tech Donation Programme benefit as soon as reasonably possible following Virgin Media O2’s validation that the Eligibility Criteria have been satisfied.
  6. All orders by new Virgin Media O2 customers for an Eligible Service that are accepted by Virgin Media O2 (a Qualifying Order) shall be subject to the Standard Terms.

B. What is the Tech Donation Programme and how can you get the benefits?

  1. The Tech Donation Programme is a social value initiative enabling Virgin Media O2 customers to support Community Calling, a digital inclusion scheme by Hubbub which re-distributes previously used and working smartphones to those in need across the UK, and provides a sim card with 6 months’ connectivity through partnership with the National Databank, run by The Good Things Foundation.
  2. The Tech Donation Programme will give customers who meet the Eligibility Criteria the option to add Hubbub’s Community Calling benefit to their existing contract with Virgin Media O2 at no extra cost. Where an eligible customer opts-in to the Tech Donation Programme, they will be given the option to target their donation to either focus on digitally excluded children from the ages 11 to 16, or digitally excluded older people over the age of 65. Additionally, eligible customers can target their donation geographically. If Hubbub is unable to support the requested community group for whatever reason, Virgin Media O2 will work with Hubbub to identify a community either geographically near to the one requested by the customer, or a comparative demographic beneficiary group.
  3. Virgin Media O2 will make the donation on the customer’s behalf according to their selection, enabling eligible customers to support beneficiaries with second-hand smartphones and connectivity. The smartphone will be gifted to digitally excluded beneficiaries by Virgin Media O2 through Hubbub’s partnership with Genuine Solutions, and the connectivity will be provided through Hubbub’s partnership with the National Databank, which will see the provision of 6 months of connectivity at 20GB monthly with unlimited calls and texts. Following this 6 month period, the beneficiary may continue their engagement with Hubbub’s Community Calling initiative to receive ongoing connectivity, which can be renewed for another 6 months through the National Databank if they meet the relevant criteria.
  4. On donation, customers will receive a report to show their impact, which can be added to their own ESG (environmental, social and governance) reports and used in external promotion.
  5. If we remove the Tech Donation Programme benefit in accordance with our sole discretion, your Eligible Service shall continue and your minimum period will be unaffected. Your Eligible Service is entirely unaffected by the cancellation of the Tech Donation Programme.

C. General

  1. The offer only applies where there is sufficient capacity on the Virgin Media O2 network. All Qualifying Orders are subject to survey and serviceability checks.
  2. The Tech Donation Programme benefit will be delivered within the contract term. E.g. if a customer has signed a contract for 2 years, the Tech Donation Programme benefit will be delivered within this timeframe.
  3. Incomplete benefit requests or applications that are not in accordance with these terms, fail to meet the Eligibility Criteria or the benefit request instructions will be rejected.
  4. Virgin Media O2 reserves the right to withdraw this benefit at any time and without notice, or to refuse any order where it thinks you or any order does not qualify. In the event of any dispute the decision of Virgin Media O2 is final. No correspondence will be entered into.
  5. Benefit valid on all Qualifying Orders placed by you at any time on or after 12:01am on 25 September 2023 that satisfy the Eligibility Criteria.

Virgin Media O2 accepts no responsibility for any matter dealt with by its partners relating to this promotion, nor provides any guarantee in relation to their performance or otherwise. Virgin Media O2 will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.
  7. Virgin Media O2 decision is final with regard to all promotional matters.
  8. By participating in the promotion and requesting your Virgin Media O2 Tech Donation Programme benefit, you will be deemed to have accepted and be bound by these terms. These terms prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry and claim instructions are deemed to form part of the promotional terms.
  9. Data Protection: By participating in the Tech Donation Programme, you consent to the transfer of your, or your employee’s, personal data to Virgin Media O2 and the use of their personal data for the purposes of the administration of this promotion and any other purposes to which you have consented.   10. These terms and conditions shall be governed by English law and the English courts shall have exclusive jurisdiction.
